Terms of Use – EveryBizCard
Last updated: October 14, 2026
These Terms of Use govern your use of the EveryBizCard mobile app for iOS and Android.
1. Provider and Scope
- The EveryBizCard app (“App”) is provided by NEWWORK Software SE, Leipziger Platz 2, 10117 Berlin, Germany, represented by its CEO Dr. Jens Krüger. Phone: +49 30 23590473, email: info@newwork.com. Commercial register: Amtsgericht Charlottenburg (Berlin) (“Provider”, “we”, “us”).
- These Terms apply to everyone who downloads, installs or uses the App (“User”, “you”).
- Conflicting terms of the User apply only if we expressly agree to them in writing.
- These Terms are concluded between you and us only, not with Apple Inc. (“Apple”) or Google LLC (“Google”). The terms of the app store from which you obtained the App apply in addition (Section 9).
2. Description of Services
- The App lets you photograph business cards with your device camera or import existing images. The App automatically recognizes the text on the card (text recognition) and suggests a contact entry.
- You can review and edit the suggested contact and save it to your device's address book or within the App.
- To recognize text, images of business cards are transmitted wholly or partly to servers operated by the Provider or its service providers and processed there. Details are set out in the Privacy Policy (Section 5).
- Some features require access to the camera, photos and contacts. You grant these permissions via your device's operating system (iOS or Android) and may revoke them there at any time. Without the relevant permission, the affected features are unavailable.
- We may further develop the App and change features, provided the core service – converting business cards into contacts – is retained and the change is reasonable for you. Paid features will not be removed during an active subscription without equivalent replacement.
3. License
- We grant you a simple, non-transferable, non-sublicensable and revocable right to use the App on devices that you own or control. Use of the iOS version is also subject to the Usage Rules of Apple's Media Services Terms and Conditions; use of the Android version is also subject to the Google Play Terms of Service.
- All rights in the App, in particular copyrights and trademark rights in the software, design and the name EveryBizCard, remain with the Provider or its licensors.
- You may not copy, modify, reverse engineer, decompile or disassemble the App, except where mandatory law permits this (Sections 69d, 69e German Copyright Act, UrhG).
- You may not rent, lend, resell the App or circumvent any protection mechanisms.
- Content you create with the App (in particular images and contact data) remains your content. We receive only the rights technically necessary to provide the features.
4. User Obligations
- Business cards contain personal data of third parties. You are responsible for collecting, storing and using this data lawfully. When using the App for business purposes, you are generally the controller within the meaning of the GDPR.
- You will not use contacts created with the App for unsolicited advertising (e.g. under Section 7 German Act Against Unfair Competition, UWG), spam, harassment or other unlawful purposes.
- You will not upload content to the App that infringes third-party rights or is otherwise unlawful.
- You will check recognized contact data for accuracy before saving it (see Section 7).
- You will not interfere with the technical operation of the App or our servers, for example through automated mass requests or attacks.
- If a User materially breaches these obligations, we may block their access to server-based features, taking the User's legitimate interests into account.
5. Privacy
- How we process personal data is described in our Privacy Policy at https://newwork.eu/apps/privacy/everybizcard.html. It is also available in the App and on the App's store pages.
- Where business cards are processed on our servers and you use the App for business purposes, we process third-party data on your behalf. This is governed by our separate data processing agreement under Art. 28 GDPR, which is linked on the App's store pages.
6. Plans, Scan Allowances and Payment
- The App can be downloaded free of charge and is offered in three plans: Free, Pro and Power. The current features and prices of each plan are shown in the App and on the App's store page before purchase.
- Each business card image processed by text recognition counts as one scan.
- Free: Every account receives 20 scans in total without a subscription (“lifetime scans”). This allowance is granted once and is not renewed, either monthly or otherwise.
- Pro and Power: Pro and Power are paid subscriptions that include 30 scans (Pro) or 120 scans (Power) per billing month. A billing month is the period of one month beginning on the day the subscription starts and on the same day of each following month. The scan allowance resets at the start of each billing month.
- Unused scans from a billing month do not roll over to the next billing month and expire at the end of that billing month.
- Once the available scans are used up, further scans are possible only after the allowance resets or after upgrading to a higher plan. Contacts already created remain available.
- If a subscription ends, the account reverts to the Free plan. Lifetime scans already used are not restored.
- Subscriptions are purchased and billed through the Apple App Store (iOS) or Google Play (Android), depending on where you obtained the App. The respective store's terms govern payment and invoicing and, subject to paragraph 9, refunds. Refund requests can be made to Apple at reportaproblem.apple.com or to Google via Google Play.
- Mandatory statutory consumer rights remain unaffected, in particular the statutory right of withdrawal and statutory warranty rights. Nothing in these Terms or in the store terms limits these rights.
- Subscriptions renew automatically for the selected term unless cancelled before the end of the current period in accordance with the rules of the respective store; for the Apple App Store, this means at least 24 hours before the period ends. You cancel in the subscription settings of your Apple Account or Google Play account. Deleting the App or your EveryBizCard account does not cancel a subscription.
7. Warranty and Availability
- Automatic text recognition is not error-free. Unusual fonts, poor lighting, reflections, special layouts or languages may lead to incorrectly or incompletely recognized data. You are responsible for checking contact data before saving it.
- For consumers, the statutory warranty rights for digital products apply (Sections 327 et seq. German Civil Code, BGB). We provide the updates required to keep the App in conformity with the contract.
- Server-based features are available within the limits of what is technically feasible. Maintenance, third-party outages or force majeure may cause temporary interruptions.
- The App is a tool for managing contacts and does not replace your own backups. We recommend backing up your contacts regularly, e.g. via iCloud or your Google account.
8. Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (ProdHaftG), and to the extent of any guarantee we have given.
- For slightly negligent breaches of an essential contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract. Essential obligations are those whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment the User may regularly rely.
- Otherwise, liability for slight negligence is excluded.
- These limitations also apply in favour of our employees, representatives and vicarious agents.
9. App Store Terms
Google Play (Android): If you obtained the App from Google Play, the Google Play Terms of Service apply in addition. Google is not a party to these Terms and is not responsible for the App or its content.
Apple App Store (iOS): If you obtained the App from the Apple App Store, the following terms also apply. Apple requires them in every custom app license agreement.
- Parties: These Terms are concluded between you and the Provider only, not with Apple. The Provider, not Apple, is solely responsible for the App and its content.
- Maintenance and support: The Provider alone provides maintenance and support for the App. Apple has no obligation to do so.
- Warranty: If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims arising from a failure to conform to a warranty are the Provider's responsibility.
- Product claims: The Provider, not Apple, is responsible for addressing any claims relating to the App. This includes product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection or privacy law.
- Intellectual property: If a third party claims that the App or your possession and use of it infringes their intellectual property rights, the Provider, not Apple, is solely responsible for investigating, defending, settling and discharging such claims.
- Legal compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Contact: Questions, complaints and claims regarding the App should be directed to the address in Section 1.
- Third-party terms: When using the App, you must comply with the terms of any third-party services you use with it.
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
10. Term, Termination and Changes
- The agreement runs for an indefinite period. You may end it at any time by deleting the App and your EveryBizCard account. Deleting your EveryBizCard account or the App does not automatically cancel a subscription purchased via the Apple App Store or Google Play. You must cancel it separately in your app store account (Section 6).
- We may terminate the agreement with 30 days' notice, effective no earlier than the end of the current subscription period. The right to terminate for good cause remains unaffected.
- When the agreement ends, we delete server-side data stored in the App in accordance with the Privacy Policy. Contacts saved to your device's address book remain on your device.
- We will notify you in the App of changes to these Terms at least 30 days before they take effect. Material changes, for example to services or prices, take effect only with your express consent. Without consent, you may continue to use the App under the previous terms where technically possible; otherwise either party may terminate the agreement.
11. Final Provisions
- These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in another country, the mandatory consumer protection laws of that country remain unaffected.
- If the User is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin, Germany.
- We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
- If any provision of these Terms is invalid, the remaining provisions remain valid. The invalid provision is replaced by the statutory provision.

Nutzungsbedingungen – EveryBizCard
Stand: 14. Oktober 2026
4. Pflichten der Nutzer
- Visitenkarten enthalten personenbezogene Daten Dritter.
- Free: Jedes Konto erhält ohne Abonnement insgesamt 20 Scans („Lifetime-Scans“).
